Purchase - sale rules
1. General provisions
These Terms of Purchase and Sale (hereinafter - the Terms) establish the mutual rights, obligations and responsibilities of the person purchasing the goods in the e-shop www.kinect.lt (hereinafter - the Buyer) and www.kinect.lt (hereinafter - the Seller) when the Buyer purchases the goods in the e-shop . By purchasing goods in the e-shop, the Buyer agrees to the application of these Terms.
2. The moment of concluding the purchase and sale agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer has formed a shopping cart in the e-shop, provided the delivery address, selected the payment method and read these terms, clicks the "Confirm Order" button and is valid until fully performance. In cases where the Buyer does not agree with all or part of the Terms, he must not place an order.
2.2. Each contract concluded between the Buyer and the Seller is stored in the database of www.kinect.lt.
3. Buyer's rights
3.1. The Buyer has the right to purchase goods in the e-shop in accordance with these Terms and Conditions and the legal acts of the Republic of Lithuania.
3.2. The Buyer (consumer) has the right to withdraw from the e-shop purchase and sale agreement with the Seller (except for the agreement on the sale of audiovisual works and phonograms in any video or audio media, computer programs, if the buyer (consumer) has violated packaging protection). by notifying the Seller in writing within 7 working days from the date of delivery of the goods. The Buyer has the right to withdraw from the contract of purchase and sale of goods with the Seller only if the goods and their packaging have not been damaged and its appearance has not substantially changed.
3.3. The Buyer has other rights provided for in the Conditions and legal acts of the Republic of Lithuania.
4. Obligations of the Buyer
4.1. The buyer must pay the price of the goods and their delivery, as well as other payments (if such are specified when concluding the contract) and accept the ordered goods.
4.2. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately.
4.3. The Buyer must confirm the payment order at the Buyer's bank no later than within 24 hours from the click of the "Confirm Order" button. If the payment order is not confirmed within this term, the Seller has the right to consider that the Buyer has withdrawn from the sales contract. The goods selected by the Buyer are reserved and the Seller undertakes to execute the purchase and sale agreement only when the Seller receives a notification from the Buyer's bank about payment for the selected goods.
4.4. The Buyer must comply with other requirements established in the Conditions and legal acts of the Republic of Lithuania.
5. Seller's Rights
5.1. If the Buyer tries to impair the operation or stable operation of the e-shop or violates its obligations, the Seller may, without prior notice, limit, suspend (terminate) its access to the e-shop and shall not be liable for any related losses of the Buyer.
5.2. The Seller has the right to temporarily or indefinitely terminate the operation of the e-shop without separate notice and is not liable for any related losses of the Buyer.
5.3. The Seller has the right to unilaterally change these Terms by publishing the changed Terms on the e-shop website. The amendments are effective for all post-publication transactions from the date of publication.
5.4. The Seller has other rights provided for in the Conditions and legal acts of the Republic of Lithuania.
6. Responsibilities of the Seller
6.1. The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the e-shop. The seller does not provide any guarantee that the e-shop will operate continuously or that the data transmission will be error-free. The Seller shall not be liable for any losses of the Buyer related to malfunctions of the e-shop and / or data transmission errors.
6.2. The Seller, in case of important circumstances, unable to provide the Buyer with the ordered goods, undertakes to offer an analogous product, and if the Buyer refuses to accept an analogue of the goods, return the money paid by the Buyer within 5 working days. In this case, the Seller is released from liability for non-delivery of the goods.
6.3. The seller undertakes to comply with the other requirements set out in these rules.
7. Delivery of goods
7.1. The goods are delivered at the expense of the Buyer by the transport company or the goods are picked up by the Buyer at his own expense from the place specified by the Seller. In separate cases specified by the Seller, the goods are delivered at the expense of the Seller.
7.2. The exact delivery price depends on the weight, volume, dimensions and place of delivery of the ordered goods, therefore the final delivery price will be visible only after the order is formed.
7.3. Usually the goods are delivered to the address specified by the Buyer within 2 working days from the received payment for the goods and transportation of the goods, if the goods are in the Seller's warehouses
